Personal data means any information relating to an identified or identifiable natural person. An identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, identification number, location data, an online identifier, or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.

II. Sources and categories of personal data processed

The Controller processes personal data that you have provided or personal data obtained by the Controller in connection with the performance of your order.
The Controller processes your identification and contact details and data necessary for the performance of a contract.

III. Legal basis and purpose of personal data processing

The legal basis for processing personal data is:
performance of a contract between you and the Controller pursuant to Article 6(1)(b) of the GDPR;
the Controller’s legitimate interest in direct marketing, in particular sending commercial communications and newsletters, pursuant to Article 6(1)(f) of the GDPR;
your consent to processing for direct marketing purposes, in particular sending commercial communications and newsletters, pursuant to Article 6(1)(a) of the GDPR in conjunction with Section 7(2) of Act No. 480/2004 Coll., on Certain Information Society Services, where no goods or services have been ordered.
The purposes of processing personal data are:
processing your order and exercising the rights and obligations arising from the contractual relationship between you and the Controller. Personal data necessary for successfully processing the order (name, address and contact details) is required when an order is placed. Providing personal data is a necessary requirement for entering into and performing a contract; without it, the contract cannot be concluded or performed by the Controller;
sending commercial communications and carrying out other marketing activities.
The Controller does not carry out / carries out automated individual decision-making within the meaning of Article 22 of the GDPR. You have given your explicit consent to such processing.

IV. Data retention period

The Controller retains personal data:
for the period necessary to exercise the rights and obligations arising from the contractual relationship between you and the Controller and to assert claims arising from those contractual relationships (for 15 years following termination of the contractual relationship);
until consent to processing for marketing purposes is withdrawn, for no longer than …. years where personal data is processed on the basis of consent.
After the retention period expires, the Controller will erase the personal data.

V. Recipients of personal data (the Controller’s subcontractors)

Recipients of personal data are persons who:
participate in the delivery of goods / services / processing of payments under a contract;
participate in operating the services;
provide marketing services.
The Controller does not intend / intends to transfer personal data to a third country (outside the EU) or an international organisation. Recipients of personal data in third countries are providers of mailing services / cloud services.

VI. Your rights

Subject to the conditions set out in the GDPR, you have:

  1. the right of access to your personal data pursuant to Article 15 of the GDPR;
  2. the right to rectification of personal data pursuant to Article 16 of the GDPR, or restriction of processing pursuant to Article 18 of the GDPR;
  3. the right to erasure of personal data pursuant to Article 17 of the GDPR;
  4. the right to object to processing pursuant to Article 21 of the GDPR;
  5. the right to data portability pursuant to Article 20 of the GDPR;
  6. the right to withdraw consent to processing in writing or electronically using the Controller’s address or e-mail address stated in Article III of this policy;
  7. the right to lodge a complaint with the Office for Personal Data Protection if you believe that your right to the protection of personal data has been infringed.

VII. Personal data security

The Controller declares that it has adopted all appropriate technical and organisational measures to secure personal data.
